Point-of-Sale (POS) Data Access Right

A lease provision granting the landlord direct or on-demand access to a tenant's point-of-sale system data as a means of verifying gross sales in real time, rather than relying solely on periodic tenant-prepared reports.

As POS and enterprise resource planning systems have made granular, transaction-level sales data readily exportable, some landlords — particularly institutional owners of large power centers and malls — have pushed to negotiate direct system access or standardized data feeds in lieu of, or alongside, traditional monthly sales reports, reducing both reporting lag and the scope for manual reporting error or manipulation. National tenants generally resist broad POS access on competitive-sensitivity and data-security grounds, so negotiated outcomes typically limit access to aggregate sales totals by category rather than full transactional detail, and require the landlord to maintain confidentiality and use the data solely for lease administration purposes.
